Terms of Service

1. Acceptance

By inviting GoofBot to your Discord server, signing into the dashboard at goofbot.gyneric.net, or using any GoofBot feature on Discord or Twitch, you agree to these Terms of Service ("Terms"). If you don't agree, remove the bot and stop using the dashboard.

2. Service description

GoofBot is a Discord and Twitch community bot. It provides moderation tools, levelling, points, custom commands, tickets, Twitch event alerts, chat bridging, and a self-serve web dashboard. Features depend on the third-party APIs we connect to (Discord and Twitch); their availability is outside our control.

3. Eligibility

You must be at least 16 years old to use GoofBot. The 16+ threshold applies globally and is set to satisfy the strictest jurisdiction in which we operate (Article 8 of the General Data Protection Regulation, which requires parental consent for processing children's data under that age in most EU member states). If you operate a server that uses GoofBot, you confirm that all administrators interacting with the dashboard meet this requirement. We do not knowingly collect or process data for users below 16; if we learn we have, we will delete it.

4. Account requirements

You access the dashboard via Discord OAuth, optionally linked to Twitch OAuth. You are responsible for keeping your Discord and Twitch credentials secure. Activity initiated through your authenticated session is attributed to you. If you suspect unauthorised access, sign out from the dashboard immediately and revoke our application from your Discord and/or Twitch account settings.

5. Acceptable use

You agree not to: harass, abuse, or harm other users; use the bot to circumvent Discord's or Twitch's terms of service; attempt to reverse-engineer, disassemble, or scrape the bot or dashboard; deliberately exploit rate limits or bugs; use the bot to distribute malware, spam, or content that violates applicable law in your jurisdiction. We may suspend or remove the bot from servers we determine to be in material breach.

6. User-generated content

Custom commands, tag content, ticket transcripts, welcome messages, and any other text or media you configure ("Content") remain yours. You grant GoofBot a non-exclusive, royalty-free licence to store, process, and display that Content solely to operate the service for you. You are responsible for ensuring you have the right to post Content and that it complies with Discord and Twitch terms.

6A. Content monitoring and cooperation policy

GoofBot does not pre-screen, actively monitor, or filter content uploaded or authored by users at the time of submission. Authors of Content (server administrators, members, moderators, anyone using the bot) are solely responsible for the legality and compliance of what they post. Our role is to operate the bot infrastructure; we do not act as an editor or publisher of user content.

• No active monitoring. We do not scan, classify, or pre-approve user-uploaded images, audio, custom commands, ticket content, welcome messages, embed text, or any other Content. The dashboard surfaces showing policy notices are informational reminders to authors, not pre-publication review.
• Sole responsibility for content rests with the author. If a user uploads or posts Content that infringes copyright, violates law, or breaches our Terms, that user — not the GoofBot operator — is the responsible party.
• Action on valid notice. We will remove or disable access to Content promptly upon receipt of a valid notice — DMCA takedown notices under §512 (see the Copyright/DMCA Policy at /dmca), court orders, lawful government requests, and credible abuse reports.
• Cooperation with law enforcement and rights-holders. We will work in good faith with law enforcement agencies, copyright holders, trademark holders, and other valid claimants to investigate and remove unlawful or infringing Content. For content that is illegal regardless of jurisdiction (especially child sexual abuse material, credible threats of violence, malware, and similar categories), we will report to the appropriate authorities (e.g. NCMEC for CSAM) and remove the bot from offending servers.
• Audit retention. We retain audit logs of admin overrides, takedown notices, and abuse reports for legal-compliance purposes. These logs are not made public but may be produced under valid legal process.
• No obligation to monitor — but right to act. Nothing in this section creates an obligation for us to police the service in ways not legally required, but it does preserve our right to remove Content or restrict access at our reasonable discretion when we believe doing so is necessary to comply with law, protect users, or protect the bot's integrity.

7. Premium subscriptions

Premium and Enterprise tiers, when available, are sold and billed by third-party platforms — primarily Discord (App Subscriptions) and Patreon — under their respective terms. We do not directly handle your payment card or banking details; that information stays with the processor. The list below covers how subscriptions interact with the bot itself.

• Pricing displayed in the dashboard and in Discord's purchase sheet is exclusive of tax. Discord and Patreon collect and remit sales tax / VAT on our behalf where required.
• Subscriptions auto-renew at the end of each billing period at the then-current price. You can cancel at any time via the platform that sold you the subscription (Discord App Settings → Subscriptions, or your Patreon account).
• Refunds are governed by the selling platform's refund policy. Discord typically allows refund requests within 14 days of purchase if the subscription has not been substantially used; Patreon refunds are at the creator's discretion. We will honour any refund decision the platform makes and adjust the guild's tier accordingly.
• When a subscription ends — whether via cancellation, non-payment, refund, or expiry — the affected guild reverts to the free tier at the end of the current paid period. Premium-only configuration (custom bot identity banner, description, uploaded assets) is preserved for 30 days so re-subscribing restores the previous setup. After 30 days the data may be removed.
• Tier downgrades stop applying premium-only behaviour immediately at the end of the paid period. The bot does not retroactively undo actions taken during the paid period (e.g. nicknames already pushed to Discord, avatars already uploaded).
• We may change pricing or feature availability with at least 30 days written notice, surfaced via the dashboard and the bot's changelog. Changes do not affect the current paid period; they take effect at the next renewal.
• Chargebacks initiated outside the platform's normal refund flow may result in suspension of the affected guild's premium access until the dispute is resolved.
• Bot Tester comps and other manually-issued comps are issued at our sole discretion, are non-transferable, and may be revoked at any time without notice.

8. Service availability

We provide GoofBot on a best-effort basis without service-level guarantees. Discord, Twitch, our hosting provider, or our backup provider may experience outages outside our control. We are not liable for downtime, data loss, or features that fail due to upstream provider issues. We aim to maintain near-24/7 uptime but reserve the right to perform maintenance with reasonable notice.

9. Termination

You may stop using GoofBot at any time by removing the bot from your Discord servers and revoking the application from your Discord and Twitch settings. We may suspend or terminate access to the service for accounts or guilds that breach these Terms, on legal request, or to protect users from harm.

10. Disclaimer of warranties

GoofBot is provided "as is" without warranties of any kind, express or implied. We do not warrant that the bot will be uninterrupted, error-free, or fit for any particular purpose. Use of the bot is at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising out of or relating to GoofBot is limited to the greater of (a) $50 USD or (b) the total amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, even if we were advised of the possibility.

12. Indemnification

You agree to indemnify and hold harmless the GoofBot operator from any claim, loss, or expense arising from your use of the bot, your User Content, or your violation of these Terms or applicable law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the dashboard and via the bot's changelog at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing law and jurisdiction

GoofBot is operated from the United States. These Terms are governed by the laws of the State of [STATE TBD], United States, without regard to conflict-of-laws principles, and disputes between you and us will be resolved in the state or federal courts located in that state. Nothing in this section limits the rights you have under mandatory consumer-protection or data-protection laws of the country where you live, including the next two sections.

15. EU, EEA, and UK users

If you live in the European Union, the European Economic Area, the United Kingdom, or Switzerland, you keep all the rights you have under your local law and the General Data Protection Regulation ("GDPR") or UK GDPR. Nothing in these Terms reduces those rights. In particular:

• You can bring proceedings about these Terms in the courts of your country of residence, in addition to or instead of the US courts named above, where your local consumer-protection law allows it.
• Your data-subject rights — access, rectification, erasure, restriction, portability, objection, and withdrawal of consent — are described in detail in the Privacy Policy and apply regardless of where we are based.
• You can contact your local data-protection authority if you believe we have processed your data unlawfully.
• We do not require you to waive any GDPR or UK GDPR right as a condition of using GoofBot. Any term that purports to do so does not apply to you.

16. California users

If you live in California, you have rights under the California Consumer Privacy Act ("CCPA") and the California Privacy Rights Act ("CPRA"), including the right to know what personal information we collect, the right to delete it, the right to correct it, and the right to opt out of any sale or sharing of personal information. We do not sell or share personal information for cross-context behavioural advertising. Details on how to exercise these rights are in the Privacy Policy.

17. Intellectual property

GoofBot, the bot's name, logo, dashboard design, source code, documentation, and accumulated configuration tools are the property of the GoofBot operator and its licensors, protected by US and international copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the bot and dashboard for their intended purposes. Reverse-engineering, scraping, automated extraction, or unauthorised redistribution of the bot's code or dashboard is not permitted.

18. Beta features

From time to time we make experimental features available — typically labelled "Beta", "Preview", "Dev", or "Coming soon" in the dashboard. Beta features are provided as-is, may change or be removed without notice, and are excluded from the warranty disclaimer and any service expectations of stable features. Feedback on beta features is appreciated and may be used to improve the product.

19. Severability

If any provision of these Terms is found to be unenforceable in a particular jurisdiction, the remainder of the Terms remains in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

20. Entire agreement

These Terms, together with the Privacy Policy and any policies referenced in them, constitute the entire agreement between you and us regarding GoofBot and supersede any prior or contemporaneous agreements on the subject. No oral or informal representation modifies these Terms.

21. No waiver

Our failure to enforce a right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing.

22. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to outages of Discord, Twitch, our hosting provider, or our backup provider; natural disasters; armed conflict; civil unrest; cyber attacks; pandemic; or government action.

23. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of substantially all assets, or by operation of law, without your consent but with reasonable notice.

24. Electronic communications

By using GoofBot, you agree that we may communicate with you electronically — through Discord direct messages, dashboard banners, the Twitch chat bot, or notices posted in the GoofBot HQ server — and that those communications satisfy any legal requirement for written notice. You can opt out of non-essential communications via the dashboard's notification settings; you cannot opt out of legally-required notices about the service or your account.

25. Export controls

GoofBot is operated from the United States and is subject to US export-control laws. You confirm that you are not located in, under the control of, or a national or resident of any country subject to comprehensive US sanctions, and that you are not on any US government list of prohibited or restricted parties.
